What is a cookie?

BEAUMARLY GROUP TERMS AND CONDITIONS OF SERVICES
This document constitutes the general booking conditions (the “GTC”) of the BEAUMARLY Group. The CGs will be
accessible at https://www.beaumarly.com (the “Site”).
By making a reservation with our Establishments, you (the “Customer” or “You”) accept these T&Cs, and
acknowledge that you have read our available Personal Data Protection Policy as well as our
Cookie policy available HERE.
1. DEFINITIONS
Hereinafter, the terms below will have the following meaning: “Beaumarly Group” means:
- Beaumarly SAS, parent company of the Beaumarly Group, registered in the Commercial and Commercial Register
Paris companies under the number SIREN 327 823 381 and whose head office is located at 28, rue de Venise 75004
PARIS, France;
- Les filiales et autres sociétés affiliées à Beaumarly prenant part à ses activités ;
- Les établissements exploités sous l’une des marques du Groupe Beaumarly dans le monde.
« Beaumarly SAS » désigne la société mère du Groupe Beaumarly, ayant son siège social au 28, rue de Venise 75004 PARIS,
France, détenant notamment la marque Beaumarly sous laquelle les Etablissements sont exploités. Pour les besoins des
présentes Beaumarly SAS agit au nom et pour le compte de l’ensemble de ses Etablissements.
« Etablissement(s) » désigne individuellement ou collectivement les hôtels, restaurants, club, bar ou plus généralement tout
lieu où Beaumarly fournit des produits et services et pour lesquels il est possible pour un Client d’effectuer une Réservation.
La liste de nos Etablissements est disponible sur les Sites du Groupe. Si besoin, la liste des filiales, et établissements peut être communiquée sur simple demande.
« Client(s) » désigne toute personne physique majeure ayant la pleine capacité juridique lors de la souscription du contrat de réservation, ou personne morale dûment représentée par une personne physique ayant qualité et capacité juridique pour la représenter
« Prestation(s) » : désigne notamment les prestations d’hébergement, de restauration et de club proposées et fournies par les Etablissements, ainsi que l’ensemble des prestations annexes proposées également par les Etablissements (restauration, bar, extras, etc.)
« Réservation(s) » : désigne toute réservation d’une Prestation dans un des Etablissements, qu’elle soit faite en ligne, par
téléphone ou par mail. Les Réservations effectuées sur devis dans le cadre d’un Evènement – ci-après définis – sont également soumises aux présentes conditions mais peuvent se voir application des dispositions particulières.
« Évènement(s) » désigne toute réservation au sein d’un Établissement d’un service collectif pour un groupe de plus de dix (10) personnes, impliquant des conditions contractuelles spécifiques de réservation, d’annulation et de facturation.
« Privatisation(s) » désigne toutes prestations par laquelle l’intégralité — ou une portion strictement réservée — des espaces et services d’un Etablissement est mise à disposition exclusive d’un client ou d’un groupe.
Pendant la période définie dans le devis ou contrat, ces espaces sont fermés à la clientèle extérieure et accessibles uniquement au client et aux personnels dédiés.
« Site(s) » : service électronique exploité par le Groupe Beaumarly sur le réseau internet depuis un terminal fixe ou mobile, que ce soit au titre du Groupe Beaumarly ou de chaque Etablissement en propre.
2. CHAMP D’APPLICATION
1.1. Etendue
Les présentes CG s’appliquent, sans restriction ni réserve à l’ensemble des Réservations auprès des Etablissements sous enseigne Beaumarly.
Des conditions particulières spécifiques peuvent néanmoins être applicables dans le cadre des Réservations de groupe ou pour des évènements particuliers.
1.2. Durée
Les présentes CG s’appliquent pendant toute la durée de commercialisation des prestations de restauration, d’hébergement
temporaire et autres prestations (bar, club…) proposées par les Etablissements.
Beaumarly se réserve le droit, sans préavis ni indemnité, de fermer temporairement ou définitivement, en totalité ou
partiellement, les Etablissements, les Sites, l’espace de réservation en ligne ou tout autre procédé de réservation.
Beaumarly ne sera aucunement responsable des dommages de toute nature qui peuvent résulter d’une indisponibilité
temporaire de tout ou partie des Sites ou des procédures de réservations.
Beaumarly se réserve le droit d’adapter ou de modifier à tout moment les présentes CG. En cas de modification, les CG en vigueur au moment de la Réservation seront appliquées.
1.3. Régime juridique
Les présentes CG sont soumises aux dispositions des articles L. 221-1 et suivants du Code de la consommation.
Toute Réservation est soumise aux présentes CG ainsi qu’aux conditions particulières pour chacune des Prestations proposées par Beaumarly
1.4. Objet
Les présentes CG définissent les droits et obligations des parties dans le cadre des Réservations de Prestations proposées par Beaumarly. Les CG régissent toutes les étapes nécessaires à la réalisation et au suivi de la Réservation, à son maintien et à sa validité, et au paiement du prix afférent.
3. CAPACITE ET ACCEPTATION DU CLIENT
Tout Client reconnaît avoir la capacité de contracter aux conditions décrites dans les CG présentées ci-après, c’est à dire avoir la majorité légale et ne pas être sous tutelle ou curatelle. A cet effet, Beaumarly se réserve le droit de solliciter du Client, lors de son arrivée dans l’Etablissement, une pièce justificative de son identité indiquant notamment sa date de naissance. Toute personne mineure devra être obligatoirement accompagnée par une personne qui justifie de l’autorité parentale sur ce mineur.
Concernant les Clients étrangers, ils s’obligent à remplir une fiche individuelle de police dans les pays concernés par une
telle réglementation, conformément en France aux dispositions de l’article R.611-42 du Code de l’entrée et du séjour des
étrangers. Le Client reconnait que les présentes CG font partie intégrante du contrat de Réservation qu’il conclut avec Beaumarly et qu’il en a pris connaissance préalablement à la validation de sa Réservation et en avoir accepté librement l’intégralité des termes.
Le Client accepte donc que les CG, ou tout autre document contractuel l’informant des caractéristiques des Prestations et tarifs particuliers associés lui soient présentés en ligne sur les Sites aux fins de conclusion du contrat de Réservation. Le Client déclare donc avoir obtenu de Beaumarly et des Etablissements toutes les informations nécessaires préalablement à sa Réservation. Toute validation de Réservation par le Client nécessite l’acceptation préalable des présentes CG dans leur intégralité. Il dispose de la faculté de sauvegarder et d’éditer les présentes CG à partir des Sites en utilisant les fonctionnalités standards de son navigateur et/ou ordinateur.
Le Client accepte expressément que la saisie des informations bancaires requises lors du processus de Réservation, l’acceptation des présentes CG et la validation de la demande de Réservation (notamment par l’action de clic par le Client sur le bouton « valider ») constituent une signature électronique au sens de l’article 1367 du Code Civil qui a, entre les parties, la même valeur qu’une signature manuscrite.
4. PROCESSUS DE RESERVATION
Les Sites offrent la possibilité au Client de réserver une table et/ou un hébergement dans l’Etablissement de son choix en fonction de ses caractéristiques. Le Client peut réserver une chambre suivant des tarifs contractuels transparents avec ou sans options ou extras laissés à la libre souscription du Client.
Le Client reconnait avoir pris connaissance des caractéristiques de l’Etablissement sélectionné et des modalités de Réservation des Prestations disponibles sur le Site, et avoir sollicité et obtenu toute information nécessaire et/ou complémentaire pour effectuer sa Réservation en parfaite connaissance de cause. Dans nos Etablissements, les tenues correctes sont exigées.
Le Client est seul responsable des choix des Prestations et de leur adéquation à ses besoins, de telle sorte que la responsabilité de Beaumarly et des Etablissements ne peut aucunement être recherchée à cet égard.
Pour toute réservation faite en amont de l’ouverture d’un Etablissement : elle est réputée faite sous réserve d’ouverture de
l’Etablissement et d’accessibilité aux locaux réservés à la date de séjour du Client. En cas de non-disponibilité, le Client sera
prévenu au plus tard 45 (QUARANTE-CINQ) jours avant la date d’arrivée prévue.
Beaumarly proposera alors au client une réservation dans un établissement du Groupe ou autre marque selon la disponibilité, de standing similaire ou inférieur. Le Client sera libre d’accepter le changement d’établissement ou d’annuler la Réservation. En cas d’annulation de la Réservation sur ce motif par le Client, Beaumarly procédera au remboursement des éventuels acomptes versés. En aucun cas Beaumarly ne pourra être tenu pour responsable d’un retard d’ouverture ou d’un changement d’établissement proposé. Le retard dans la date d’ouverture ou le changement d’établissement ne pourra donner droit à aucune indemnité au profit du Client à l’encontre de Beaumarly ou tout autre filiale du groupe.
4.1. Processus de réservation en ligne
Les Réservations effectuées par le Client peuvent être effectuées par l’intermédiaire d’un outil de réservation accessible en ligne sur les Sites. La Réservation est réputée acceptée par le Client à l’issue du processus de Réservation par l’action de clic sur le champ « Valider ». La Réservation est réputée formée dès l’envoi de la confirmation de la Réservation par Beaumarly. Le Client s’engage, préalablement à toute Réservation, à compléter les informations demandées. Le Client atteste de la véracité et de l’exactitude des informations transmises.
4.1.1. Concernant les restaurants :
La procédure de Réservation sécurisée comprend notamment les étapes suivantes – étant précisé que, d’une part, à chaque étape, la page qui s’affiche comporte le récapitulatif des étapes précédentes, et d’autre part, qu’il est toujours possible pour le Client d’abandonner la Réservation avant de la valider définitivement, ou de faire machine arrière dans le processus de Réservation en cliquant sur l’étape précédente pour en modifier les données – :
• 1ère page : Rappel de l’établissement sélectionné ; choix de la date du repas sur le calendrier ; choix du nombre de couverts ; choix de l’horaire de début de la Prestation.
• 2ème page : Saisie de l’identité, et des coordonnées du Client et d’éventuels commentaires, allergies et habitudes
alimentaires qui seraient importants de mentionner ; Eventuelles précisions de réservation et acceptation des conditions
générales d’utilisation du service ; inscription ou non aux actualités et programmations de l’Etablissement.
• 3ème page : affichage du récapitulatif de la Réservation et des données complétées ;
4.1.2. Concernant les hôtels :
La procédure de Réservation sécurisée comprend notamment les étapes suivantes – étant précisé que, d’une part, à chaque étape, la page qui s’affiche comporte le récapitulatif des étapes précédentes, et d’autre part, qu’il est toujours possible pour le Client d’abandonner la Réservation avant de la valider définitivement, ou de faire machine arrière dans le processus de Réservation en cliquant sur l’étape précédente pour en modifier les données – :
• 1ère page : choix de la date du début du séjour (check-in date) et de la date de fin du séjour (check-out date) sur le
calendrier ; Choix du nombre d’adultes et d’enfants ;
• 2ème page : Vérification des disponibilités et choix du type et taille de la chambre, des éventuelles prestations, puis choix
du tarif ;
• 3ème page : choix du nombre de chambres ; Conditions de réservation
• 4ème page : proposition de souscription d’une assurance annulation ; affichage du récapitulatif de la Réservation ; saisie
de l’identité du Client ; du nombre de personne par chambre (adulte et enfant) ; sélection de l’heure d’arrivée ; des
demandes spéciales le cas échéant et récapitulatif des conditions générales de vente (dépôt de garantie et conditions
d’annulation)
Sélection et saisie du mode de paiement ;
• 5ème page : après avoir cliqué sur le bouton « Confirmer ma réservation », le Client doit confirmer les informations
nécessaires pour finaliser sa Réservation : son identité, ses coordonnées, son mode de paiement, ses coordonnées de Carte

CG, ainsi que la Politique de Protection des Données Personnelles.
Beaumarly accuse réception de la Réservation du Client par l’envoi d’un courrier électronique au Client à l’adresse électronique qu’il a préalablement renseignée. Dans le cas de la réservation en ligne, l’accusé de réception de la Réservation par courrier électronique récapitule les caractéristiques essentielles de la Réservation : les Prestations réservées, les tarifs, les principales conditions de réservation applicables, telles que précédemment acceptées par le Client, les dates de séjour.
4.2. Réservation par téléphone, télécopie ou par e-mail (Hors Evènement)
Lors d’une demande de réservation par téléphone, télécopie ou e-mail, l’Etablissement sélectionné propose – par téléphone,
télécopie ou e-mail adressé au numéro ou à l’adresse email d’envoi de la demande de Réservation – les tarifs disponibles en temps réels et les Prestations complémentaires afférentes en fonction de la demande du Client aux dates qu’il sollicite.
Les présentes CG et le récapitulatif de la demande de Réservation du Client sont également adressés au Client par télécopie ou email, ainsi que, le cas échéant, une demande de renseignement des coordonnées bancaires pour les besoins de l’enregistrement de la Réservation (éventuel prépaiement ou versement d’un acompte en fonction du tarif sélectionné, et pour les besoins de constitution d’une garantie bancaire).
Seule la confirmation écrite de l’enregistrement de la Réservation par télécopie ou par e-mail vaudra conclusion du contrat de Réservation.
4.3. Event Booking
4.3.1. In order to reserve or organize an Event, the Customer must, on the basis of the commercial brochures provided by Beaumarly, define his needs and, as such, provide all the elements necessary for the successful completion of the Event and in particular:
- Customer account opening form completed;
- Choice of establishment;
- Choice of the formula/menu;
- Number of beneficiaries of the Benefits;
- Budget;
- Acceptance or not of extras (In case of non-explicit refusal, the Customer will be presumed to have accepted the consumptions)
in addition and undertakes to pay for them);
- Choice of additional services if necessary (in particular sound and lights).
The event will be validated subject to the availability of the Establishment and the feasibility of the Customer's request. In case
upon acceptance, the Event will be the subject of an estimate issued by Beaumarly. This estimate must be returned signed by the Customer and accompanied, if necessary, by the payment of a deposit, to constitute acceptance. Once the estimate has been accepted and the deposit paid, the booking of the Event is deemed final and irrevocable.
4.3.2. As part of an Event, the Customer undertakes to:
- Send all information to Beaumarly as soon as possible and at the latest one week before the Event
and documents necessary for the proper understanding of the needs and the proper execution of the Event;
- Strictly comply with the technical and safety recommendations made by the Beaumarly teams;
- Guarantee Beaumarly against any action and claim by third parties in the absence of any fault attributable to it;
- Collaborate actively in the success of the Event by providing Beaumarly with all the elements necessary for the good
performance of everyone's services. The commercial proposal or quotation may include a choice between several menus. In order to be able to fully satisfy the customer, the customer must indicate his final choice to the restaurant no later than six days before the service. After this period, the selected establishment cannot guarantee the service of certain foods or drinks on the menu. In case of modification of the reservation, the provisions provided for in the article “Modification” are applicable.
4.3.3. Beaumarly reserves the right in certain cases to proceed with a bank pre-authorization. In this case, the Customer must provide him with the following elements:
- Name of the bank card holder;
- Bank card type;
- Bank card number;
- Expiry date of the bank card;
- Bank card security code;
- If necessary, identification by 3D Secure.
It is understood that the validity period of the above-mentioned bank card must be after the date of the Event. This bank imprint is intended to guarantee Beaumarly the payment of the Services in the cases provided for in these CGV. In addition to these two situations, Beaumarly will not be able to use the information given by the Customer to invoice the Event.
In the event that in the context of the provision of additional Services (e.g. Disk-Jockey, light environment,...) equipment would be made available to the Customer, Beaumarly reserves the right to ask the Customer for a financial guarantee (Deposit check) which may be cashed in the event of damage or disorder due to the Customer, his guests from its service providers or more generally from any third party for which it is responsible... The amount of this guarantee will be indicated on the estimate sent by Beaumarly.
5. TERMS OF WITHDRAWAL, MODIFICATION AND CANCELLATION
5.1. Withdrawal
The Customer is reminded, in accordance with article L.221-28 12° of the Consumer Code, that he does not have the right to
withdrawal as provided for in article L.221-18 of the Consumer Code, as long as the Services are provided on a date or according to a determined periodicity. On the other hand, the Customer may freely modify or cancel his Booking before being accepted by the Establishment.
5.2. Modification
In general, it is the Special Conditions of each Establishment that set the terms and conditions for modifying a Reservation.
As part of an Event:
Any change in the number of guests is accepted up to 72 hours before the date of the Event.
For groups of more than 25 people, if the modification exceeds 15% of the initial number, it must be
notified at least 10 days prior to the Event.
In the context of a Privatization: any modification, number of guests, menu, hours or any other substantial element must be formulated in writing and received no later than 10 days before the Event.
Tariff revision:
Past the authorized modification times:
• Any modification will result in Beaumarly issuing a new quotation, including a tariff revision
proportionate to the additional costs incurred. The Customer will have the choice to accept this new quotation; otherwise,
the entire initial estimate will remain due.
• In the event of a decrease in the number of participants, the Customer will remain liable for the entire initial estimate.
In the event of the addition of too many additional participants: Beaumarly and its Establishments cannot be held responsible for the possible impact on the quality of the Services. If this addition involved exceeding the accommodation capacity of the Establishment, Beaumarly would be obliged to refuse the reception of additional guests and could in no way be held responsible and implicated as a result.
5.3. Delay/No-show
As part of a reservation in one of our restaurants, on the day of the Service, guests must come to the restaurant at the agreed time. In case of delay, the Establishment reserves the right to make them wait. If this delay is greater than thirty minutes, the Booking will no longer be guaranteed.
Without prejudice to the application of the right of cancellation under the above conditions, any non-presentation by the Customer to
the Establishment without prior information from the Establishment to take possession of the table or the room
reserved means the release of the entire Reservation, implying the reavailability of the table (s) /nights
reserved. The non-presentation of the Customer under these conditions automatically leads to the payment of a fixed compensation in an amount fixed by the Establishment, or even under certain conditions all of the Services booked, including all the services and extras reserved, including all the services and extras reserved, including taxes, without any right to reimbursement for the benefit of the Customer.
5.4. Cancellation
The cancellation conditions are defined according to the specific conditions specific to each Establishment and according to the Reservation made. They are specified when booking. Indeed, without prejudice to the provisions referred to above, contractual conditions may allow for cancellation.
In this case, the Customer was able to take note of his right to cancel and the related contractual conditions during his selection, which is reminded before the validation of his Reservation and also in the confirmation of his Reservation sent by the selected Establishment.
Unless otherwise specified in specific conditions, the following cancellation conditions apply depending on the nature of the reservation:
Privatization of an Establishment:
• In case of cancellation by the Customer more than 10 days before the date of the Event, the deposit has already been paid in accordance
under the conditions defined in the “Payment” article of these General Conditions of Sale will remain acquired by
Beaumarly.
• In the event of cancellation by the Customer less than 10 days before the date of the Event, the Customer will be liable for the full amount
of the amount including VAT of the quote, without the possibility of reimbursement.
Event (reservation of more than 10 guests without privatization):
• For groups of more than 25 people, the applicable cancellation conditions are identical to those provided for
Privatizations.
• For groups of less than 25 people:
o In case of cancellation by the Customer more than 72 hours before the date of the Event, the deposit already paid
in accordance with the conditions defined in the “Payment” article of these General Conditions of Sale
will remain acquired in Beaumarly.
o In case of cancellation by the Customer less than 72 hours before the date of the Event, the Customer will be liable
of the total amount including VAT of the quote, without the possibility of reimbursement.
Classic reservation (less than 10 guests — excluding privatization):
• In case of cancellation by the Customer more than 24 hours before the date of the Reservation, no price revision will be
applied.
• In case of cancellation less than 24 hours before the date of the Reservation, the Establishment reserves the right to
Invoice part of the reserved Service.
In the case of an online reservation:
The Customer can use his cancellation option on the Site by clicking on the “Cancellation” button taking the Customer to the page dedicated to this purpose and where the Customer must respect the steps indicated in order to make the exercise of his right effective. In the case of other reservations, it is necessary to contact the Establishment or your preferred contact person within Beaumarly.
5.5. Interruption of service
In the event of interruption of the Services, a credit note in an amount equivalent to the price of the Reservation may be granted to the Customer. This credit note will be personal, non-refundable, non-exchangeable for cash and valid for a period of eighteen (18) months from its date of issue, exclusively for Services offered by the Establishment, subject to availability.
5.6 Post-event billing
In the absence of changes notified by the Customer and accepted by Beaumarly in writing within the time limits provided above, the amount of the signed quotation will prevail for post-event billing, as a minimum amount due.
This amount may be increased in order to include all additional services, consumption, options,
overtime or any other service actually performed on the day of the Event, whether or not they were subject to a
advance estimate, which will be invoiced in addition.
6. RATES — PAYMENT
6.1. Hotel rates
The prices of the Services are communicated to the Customer before and during the Booking process, and are valid in real time, regardless of the channel used. They apply at the exact time of the Booking request. Each rate, whether it concerns a room or an additional service, is subject to its specific conditions.
Prices are per room, for the number of people and for the dates selected. Unless you subscribe to an extra, the rate covers arrival (check-in) and departure (check-out) at the times indicated. The tourist tax (City or Tourism Tax), indicated for each rate, is payable on site and is not included in the total amount of the Reservation.
The rates are displayed including all taxes (TTC), at the VAT rate in force on the date of the Reservation, and expressed in the currency of the country according to the connection IP address. Any change in the applicable rate will automatically be reflected in the price, in particular in the event of a variation between the Booking date and that of the stay.
Bookings are payable in the local currency of the Establishment. Any conversion displayed in another currency is indicative and not contractual. In case of payment in another currency, exchange costs are borne by the Customer. If payment is made upon arrival or departure, the amount charged may vary due to changes in exchange rates.
The total price is recalled at each stage of the Booking process and confirmed in the summary sent to the Customer.
Establishments do not grant any reduction, whether discount or discount, in case of advance payment before the scheduled date, online payment during the Booking process, or payment directly on the invoice issued. The existence of so-called “Internet”, “Standard” or “Best Rate” rates does not rule out the possibility that other rates, possibly lower, were offered at an earlier or later time. The latter cannot under any circumstances be opposed to obtain a tariff adjustment. Only the contractual rate at the time of the Booking is authentic.
Unless otherwise specified, the room must be vacated by noon (12:00) on the day of departure. Any excess may result in the billing of an additional night at the current rate.
6.2 Payment
6.2.1. Payment — Event and Privatization
Subject to contrary indications or specific conditions expressly stipulated, the reservation of an Event or a Privatization must be accompanied by a signed quote.
For quotations whose total amount including VAT is less than or equal to €4,000, the Customer must provide a bank imprint as a
guaranteed, without an immediate debit being made; this imprint makes it possible to secure the reservation without engaging
payment.
On the other hand, for quotes exceeding €4,000 including VAT, a deposit of 80% of the total amount will be required when the quotation is signed. The Reservation is acquired after receipt and effective cashing of the deposit due. Extras must, if necessary, be paid on site. The balance of the total amount invoiced on the day of the Event must be paid on the day of the Service or at the latest on the day of receipt of the invoice.
6.2.2. Non-Event Payment and Privatization
Except for specific conditions requiring online payment, payment is made directly to the Establishment.
To validate a Reservation, the Customer may be required to provide his bank details, as a guarantee or as a payment according to the applicable pricing conditions, in particular in the event of prepayment required during the Booking process.
The Customer must provide his bank card information, including number without spaces, validity date and
visual cryptogram, via the secure payment platform. This requirement also applies to Bookings made by telephone, email or fax, when payment is required upon reservation or when a security deposit by credit card imprint is required depending on the rate chosen.
Beaumarly is committed to selecting a certified service provider to secure payments and verify the validity of the card. In the event of a validation failure, it is up to the Customer to contact his bank to identify the problem and proceed with his Booking again, which has not been finalized.
As part of Hotel Services, an invoice is drawn up in duplicate, one of which is given to the Customer upon departure. If, during the stay, the amount of Extras exceeds €400, the Establishment may require immediate payment. All Extras or Services consumed must be paid at the latest at the time of check-out. Cheque payments are not accepted.
6.2.3. According to the terms applicable to cases of late cancellation, excessive delay, or failure to present a guaranteed Booking by bank card, the Establishment will debit the Customer for any sum due in this respect.
7. CLAIMS
The contract is subject to French law.
For any complaint relating to a Reservation made in one of the Establishments, the Customer must send a letter by post to the reserved Establishment at the corresponding addresses mentioned on the Sites or by email to the following address:
commercial@beaumarly.com within 48 hours following the completion of the Services.
In the event of the occurrence of a technical problem and/or overbooking, preventing the Establishment from proceeding with the reservation made by the Customer, Beaumarly undertakes to inform the Customer as soon as possible and to reimburse him immediately at the price of the reservation. The Customer cannot claim any compensation, penalty or additional compensation from Beaumarly.
The Customer is informed of the possibility of using, in the event of a dispute relating to these General Conditions, a
conventional mediation procedure or any other alternative dispute resolution method, under the conditions provided for in Title I of Book VI of the Consumer Code.
After contacting the Commercial Department to try to resolve the dispute amicably, and in the absence of a satisfactory response or lack of response within sixty (60) days from the referral, the Customer may thus contact the Tourism and Travel Mediator by email via the referral form available on the www.mtv.travel website, or by mail to the following address:

As part of this mediation, the Customer may be assisted by any person of his choice or be represented by a lawyer at his expense. Each Party may also seek the opinion of an expert whose expenses are borne by it. In the event of a joint request for expertise, the costs will be shared equally between the Parties. The Parties will be free to accept or refuse the mediator's proposal.
In the event that the Customer does not wish to refer the matter to the mediator, or if one of the Parties refuses the mediation proposal, or if no amicable agreement is reached, the Parties will be free to initiate proceedings before the competent jurisdiction for a specific attribution of jurisdiction arising from a particular law or regulatory text.
8. LIABILITY — FORCE MAJEURE
8.1. Non-completion of the reservation
In any case Beaumarly cannot be held responsible in the event of non-completion of the Reservation and/or its absence of registration, and in particular due to the Customer who does not correctly make his Booking according to the conditions set out in these GTC and according to what is displayed on the Customer's fixed or mobile computer terminal during the online Booking process.
8.2. Internet network limits
In addition, by booking on one of our Sites, the Customer acknowledges and accepts the characteristics and limitations of the Internet network, in particular with regard to technical performance, response times for consulting, querying or transferring information, the risks of interruption, the risks associated with the connection, the lack of protection of certain data, the absence of protection of certain data against possible misuse and the risks of contamination by possible viruses circulating on the network. Furthermore, Beaumarly cannot be held responsible for malfunctions that may affect the Internet network and de facto the Site, or for any configuration problem or related to a given terminal or browser.
Beaumarly also does not guarantee that the Site operates without interruption, or that it does not contain computer errors.
Likewise, hypertext links on the Site may refer to other websites, Beaumarly disclaims all
responsibility for the content of these sites and the services offered.
Consequently, Beaumarly cannot, under any circumstances, be held directly or indirectly liable in the event of a routing problem or communication cuts, difficulties or impossibilities of connection or the failure of the Site server.
More particularly, Beaumarly cannot be held responsible for any damage, material or immaterial, direct or indirect, caused to Customers, their computer equipment and the data stored there, and for the consequences that may result from this on their personal, professional or commercial activity.
Likewise, although the Establishments offer, more particularly in the rooms or apartments reserved, a WiFi internet access service, in the event of a total or partial failure in the functioning of this service for any reason whatsoever, during the duration of the stay in the Establishment, it cannot result in the benefit of the Customer any right to cancel the Reservation, or to any compensation whatsoever.
8.3. Force Majeure
Beaumarly cannot be held responsible for the total or partial non-performance of its obligations under the
Reservation in the event of a force majeure event within the meaning of case law and article 1218 of the Civil Code, or more
generally any act of a third party, made by the Customer or by commercial partners, and in particular but not limited to in the event of unavailability of the Internet network, impossibility of access to the Site, external intrusion, computer viruses or in case
prepayment not authorized by the Customer's bank.
The performance of Beaumarly's obligations will then be suspended in the event of the occurrence of an event that would prevent their
total or partial realization: Beaumarly will notify the Customer as soon as possible.
8.4. Guarantee
Beaumarly strives to ensure that the photographs, graphic representations and texts reproduced to represent the Establishments give as accurate an overview as possible of the accommodation, catering and other complementary Services offered.
However, the photographs are not contractual, because, on the one hand, the various rooms, even when they fall under the same rate, all have different dimensions, and on the other hand, variations may occur, in particular due to the change of furniture, new decoration or possible renovations. Except for a Booking made with an express request for the allocation of a room and which would be confirmed in writing, in this sense, by the Establishment, the Customer cannot claim any claim as a result, as long as these variations do not relate to the essential characteristics of the Service.
8.5. Valuable objects
Subject to availability and feasibility, a safe can be made available to customers at the reception of the Establishment for any deposit of valuables so that the Customer can, upon arrival at the Establishment, request the use of this service by contacting the Establishment reception.
Under no circumstances will Beaumarly be responsible for theft or damage caused to valuables left by the Customer in the rooms or in the vehicles parked in the Establishment's car park. Consequently, by express agreement between the parties, it constitutes, in particular, a fault of the Customer, for which he will bear all the consequences, the fact of not entrusting to the management of the Establishment so that they can be placed in a safe place, personal effects, objects, jewelry, with a value estimated at more than 1,500 Euros by the Customer. Likewise, by express agreement between the parties, it constitutes in particular a fault of the Customer, the fact of leaving the door to his room unclosed, not locked, as well as the windows of the latter, during his stay.
Beaumarly cannot be held responsible for damage caused by animals present in the Establishment, which remain under the responsibility of their owner or guardian in accordance with the provisions of article 1243 of the Civil Code.
8.6. Degradations/Refusal of Customer Access
The Customer will be held responsible in the event of damage to equipment voluntary, accidental, by negligence or clumsiness as well as any damage caused to Beaumarly and will be required to reimburse Beaumarly up to the amount of the damage caused. It is understood that the Customer is also responsible for disorders attributable to his guests, his service providers or more generally any third party for which he is responsible... Any guarantee taken prior to the Services may be activated as such. When Booking an Event, Beaumarly may require that an inventory be drawn up by a bailiff, at the Customer's expense, on the day of the Event (before installing the equipment) and when the last service providers leave.
Some Establishments have a feature allowing them to include in the category of so-called “inoperative” customers any Customer with inappropriate behavior corresponding to the following categories: aggressions and incivilities, non-compliance with the hotel contract, non-compliance with security regulations, non-compliance with security regulations, theft, damage and vandalism or settlement incidents. The status of “inoperative” may lead the Establishment at the origin of this registration to refuse access or reservation to the Customer when he returns to this Establishment again.
9. PERSONAL DATA — IMAGE RIGHTS
9.1. Personal data
The personal data managed by Beaumarly is governed by our Personal Data Protection Policy, which we kindly ask you to refer to for any information or request.
9.2. Right to the image
The reservation of Services in an Establishment, as well as their consumption by Customers and/or their companions, or even the mere presence in the Establishment in no way authorizes any audiovisual recording operation, shooting, photography whatsoever in the premises and outbuildings of the Establishment including in the rooms for their commercial, promotional, advertising, press or public relations use, website illustration, etc., and more generally any collective use or likely to involve an audience. The interior architecture and graphic creations adorning the common areas and the rooms of the Establishments are protected by copyright, whose rights are fully reserved. Any audiovisual recording session, shooting, reproduction or representation of images comprising the premises and dependencies of the Establishments concerned other than for strictly private use is subject to the prior authorization of the Establishment under penalty of counterfeiting punishable, in particular, by the civil and criminal provisions of the Intellectual Property Code.
10. VARIOUS
These T&Cs are supplemented by the Legal Notice, the Personal Data Protection Policy and the Cookie Notice.
These T&Cs are governed by French law.
In the event that any of the provisions of these GTC is declared null or void, in any way and for any reason whatsoever, it will be deemed unwritten and will not lead to the nullity of the other provisions.
All disputes that may arise between the parties in connection with the interpretation and/or execution of
These T&Cs will be subject, in the absence of an amicable agreement, to the exclusive jurisdiction of the competent court under the jurisdiction of the Paris Court of Appeal, with the exception of disputes concerning non-commercial persons and for which the legal rules for the attribution of material jurisdiction apply.
